Fineer Tech (“we”, “our”, “us”) is a remote-first technology startup headquartered in Bangladesh, with strategic operations and collaborations based in Germany. We provide professional digital and technology services globally.

These Terms & Conditions govern the use of our website, services, communications, and business relationships.

2. Acceptance of Terms

By accessing our website, engaging with our services, or entering into an agreement with Fineer Tech, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.

If you do not agree, you must refrain from using our services.

3. Scope of Services

Fineer Tech provides digital services including, but not limited to:

  • Web and software development

  • UI/UX and graphic design

  • Digital consulting and support

  • Business and technical solutions

Specific service scope, timelines, deliverables, and pricing are defined through:

  • Written proposals

  • Service agreements

  • Official communications

We reserve the right to modify or discontinue services at our discretion.

4. Client Obligations

Clients agree to:

  • Provide accurate and complete information

  • Respond promptly to requests for feedback or approvals

  • Supply necessary materials, access, or credentials

  • Use delivered services lawfully and ethically

Delays caused by incomplete or late inputs may affect project timelines.

5. Intellectual Property Rights

Unless otherwise agreed in writing:

  • All work produced by Fineer Tech remains our intellectual property until full payment is received.
  • Upon full payment, the client receives ownership or usage rights as specified in the project agreement, proposal, or contract.
  • All content, graphics, layouts, designs, branding materials, source code, documents, and other deliverables created by Fineer Tech are protected by applicable intellectual property laws.
  • Clients may not reproduce, resell, redistribute, modify, or claim ownership of any pre-existing Fineer Tech assets, frameworks, templates, methodologies, or proprietary materials unless expressly granted in writing.
  • Unauthorized copying, reproduction, distribution, resale, reverse engineering, or commercial use of Fineer Tech’s designs, source code, branding assets, or website content is strictly prohibited and may result in legal action.

6. Portfolio Usage & Confidentiality

Fineer Tech may display completed projects, designs, screenshots, case studies, client names, logos, and project descriptions within its portfolio, website, presentations, proposals, and marketing materials for promotional purposes.

Where a separate Non-Disclosure Agreement (NDA), confidentiality agreement, or written restriction exists, Fineer Tech will comply with such restrictions and will not disclose protected information without authorization.

Portfolio materials are displayed solely to demonstrate Fineer Tech’s capabilities and may not be copied, reproduced, redistributed, reverse engineered, or commercially exploited without prior written permission.

7. Confidentiality

Both parties agree to maintain the confidentiality of:

  • Business information

  • Technical data

  • Personal or proprietary information

Confidential information shall not be disclosed to third parties without prior written consent, except where legally required.

8. Payments & Fees

  • Payment terms are defined in contracts or proposals

  • All invoices must be paid within the agreed timeframe

  • Late payments may result in service suspension or termination

Unless otherwise agreed in writing, all payments made to Fineer Tech are non-refundable.

9. Termination

Either party may terminate services:

  • As outlined in the agreement

  • For material breach

  • For non-payment

Upon termination:

  • All completed work must be compensated

  • Access to deliverables is governed by the agreement terms

10. Limitation of Liability

To the maximum extent permitted by law:

  • Fineer Tech shall not be liable for indirect, incidental, or consequential damages

  • Liability is limited to the amount paid for the relevant service

We are not responsible for failures caused by third-party platforms, hosting providers, or external tools.

11. Website Use

Users agree not to:

  • Misuse or disrupt the website

  • Attempt unauthorized access

  • Distribute malicious or unlawful content

We reserve the right to restrict access for violations.

12. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of Bangladesh.

Both parties agree to make reasonable efforts to resolve disputes amicably through discussion and negotiation before initiating formal legal proceedings.

13. Amendments

Fineer Tech reserves the right to update these Terms at any time. Updates become effective upon publication.
